Official Rules
NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND
WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Eligibility: VOID WHERE PROHIBITED. The Professional Bowlers
Association’s Young Guns vs. Legends Sweepstakes (the "Sweepstakes")
is open only to legal residents of the United States who are at
least thirteen (13) years old at the time of entry and who enter
from within the U.S. Employees, officers and directors of the Professional
Bowlers Association, LLC ("Sponsor"), What Counts ("Administrator"),
and each of their parent and affiliate companies as well as the
immediate family (spouse, parents, siblings and children) and household
members of each employee, officer and director are not eligible.
Subject to all applicable federal, state, and local laws and regulations.
Void where prohibited. Participation constitutes participant's full
and unconditional agreement to these Official Rules and Sponsor
and Administrator's decisions, which are final and binding in all
matters related to the Sweepstakes. Winning a prize is contingent
upon fulfilling all requirements set forth herein.
2. Sponsor: Professional Bowlers Association, LLC, a Delaware limited
liability company.
3. Promotion Period: The Sweepstakes begins on October 26, 2006
at 12:00 a.m. Eastern Time ("ET") and ends on March 1,
2007 at 11:59 p.m. ET (the "Promotion Period"). Administrator's
computer is the official time keeping device for the Sweepstakes.
4. How to Enter: Participants must provide and submit valid and
truthful information in the fields on the competition sign up page:
e-mail address, physical address, date of birth, zip code and state.
Participants must also agree to the Sweepstakes Terms and Conditions.
The participant will thereafter receive confirmation of their participation
in the Sweepstakes through e-mail. Sponsor is not responsible for
error, omission, interruption, deletion, defect, delay in operations
or transmission, theft or destruction or unauthorized access to
or alterations of entry materials, or for technical network, telephone
equipment, electronic, computer, hardware or software malfunctions
of any kind, or inaccurate transmission of or failure to receive
entry information by Sponsor on account of technical problems or
traffic congestion on the Internet, at any web site or any combination
there of. Sponsor is not responsible for any injury or damage to
participants’ or any other person's computer related to or
resulting from downloading any materials in the Sweepstakes, or
for mail-in entries that are lost, late, misdirected, damaged, incomplete,
altered, illegible or postage-due. All entries become Sponsor’s
property and will not be returned. Sponsor reserves the right to
cancel the electronic method of Sweepstakes entry if it becomes
technically corrupted. Participants may be disqualified, at the
sole discretion of Sponsor.
5. Drawing: Administrator is an independent judging organization
whose decisions as to the administration and operation of the Sweepstakes
and the selection of the potential winners are final and binding
in all matters related to the Sweepstakes. Administrator will randomly
select the first winner from among all eligible entries received
during the Promotion Period, on or around January 18, 2007. The
Grand Prize winners for both Adult and Youth categories will be
drawn on or around March 1, 2007. The potential winner will be notified
by mail, email or phone and announced on an ESPN telecast. Each
potential winner (parent/legal guardian if winner is a minor in
his/her state of residence) will be required to sign and return
to Sponsor, within ten (10) days of the date notice or attempted
notice is sent, an affidavit of eligibility and liability/publicity
release in order to claim his/her prize. If a potential winner cannot
be contacted, or fails to sign and return the affidavit of eligibility
and liability/publicity release within the required time period,
potential winner forfeits prize. Potential winner must continue
to comply with all terms and conditions of these Official Rules,
and winning is contingent upon fulfilling all requirements. In the
event that a potential winner forfeits the prize or is disqualified
for any reason, Sponsor will award the applicable prize to an alternate
winner by random drawing from among all remaining eligible entries.
Only three (3) alternate drawings will be held after which the prize
will remain unawarded. Prizes will be awarded to verified winners.
6. Prizes: Grand Prize for entrants 21 years of age or older is
a trip for two (2) to Uncasville, Connecticut. Package includes
airfare from a major U.S. gateway airport closest to winner's residence
(determined by Sponsor in its sole discretion) from within the United
States, lodging at the Mohegan Sun Casino for 2 nights and tickets
to the Tournament of Champions. Winner must complete the trip by
April 2, 2007 or prize will be forfeited in its entirety. Trip must
be booked at least twenty-one (21) days prior to departure. Travel
must be roundtrip. Sponsor will determine airline and flight itinerary
in its sole discretion. The trip may not be combined with any other
offer and travel may not qualify for frequent flyer miles. No refund
or compensation will be made in the event of the cancellation or
delay of any flight. Travel and accommodations are subject to availability.
Certain restrictions and blackout dates may apply. Travel is subject
to the terms and conditions set forth in these Official Rules, and
those set forth by the Sponsor's airline carrier of choice as detailed
in the passenger ticket contract. All expenses and incidental travel
costs not expressly stated in the package description above, including
but not limited to, ground transportation between winner's home
and departure airport, meals, hotel room service, laundry service,
alcoholic beverages, merchandise, souvenirs, local and long distance
telephone calls, tips, gratuities, incidentals, passenger tariffs
or duties, surcharges, airport fees, service charges or facility
charges, personal charges at lodging, security fees, taxes or other
expenses are the responsibility solely of winner. Unless children
of winner, travel companions must be eighteen (18) years of age
or older as of the date of departure and must travel on same itinerary
and at the same time as the winner. Travel companions must execute
and return liability/publicity releases prior to issuance of travel
documents and travel. Travel restrictions, conditions and limitations
may apply. If in the judgment of Sponsor air travel is not required
due to winner's proximity to prize location, ground transportation
will be substituted for roundtrip air travel at Sponsor's sole discretion.
Sponsor will not replace any lost, mutilated, or stolen tickets,
travel vouchers or certificates. Trip and all trip components may
not be sold, traded, refunded or transferred, or rescheduled to
dates not within the fulfillment period set forth above. Trip is
not redeemable for cash in whole or in part. Approximate Retail
Value ("ARV"): $4,000. Actual value may vary based on
airfare fluctuations and distance between departure and each destination.
Prize is non-transferable and no substitution or cash redemptions
will be made except as provided herein at the Sponsor's sole discretion.
Sponsor reserves the right to substitute a prize for one of equal
or greater value if the designated prize should become unavailable
for any reason. Winner is responsible for all taxes and fees associated
with prize receipt and/or use. Odds of winning a Sweepstakes prize
depend on the number of eligible entries received during the Promotion
Period. Limit one (1) prize per person/per household. TOTAL ARV
OF ALL PRIZES: $8,000
Grand prize for entrants 13-20 years of age is a visit to their
home bowling center by a 2006-07 Denny’s PBA Tour exempt bowler.
Package includes a private clinic for the winner and five (5) friends
at the winner’s local bowling center. Winner must reside in
the United States.
First prize for entrants 13 years of age and older is four (4)
bowling balls, a PBA ball bag and bowling shoes. The bowling ball
selections are at the sole discretion of Sponsor and is limited
to stock on hand.
A prize won by a minor (as minor is defined by the jurisdiction
of minor's residence) will be awarded in the name of, or to, the
minor's parent or legal guardian, or as may otherwise be deemed
appropriate by Sponsor, in its sole judgment. The parent or guardian
of a winning-minor must execute all documents and agree to all obligations
and undertakings on behalf of himself/herself and the winning minor,
or the prize may be forfeited and awarded to an alternate winner.
7. Odds of Winning: The odds of winning are determined by the number
of overall entries received. Each participant will get a chance
to send contest notice five friends the e-mail provided in the sign
up form. The participant is responsible for filling in that contest
area. For each valid and unique Contest sign up made through the
participants entry the participant gets 1 (one) additional entry
into the competition.
8. Release: By participating in the Sweepstakes, participants agree
to release and hold harmless Sponsor and Administrator, and each
of their respective parent companies, subsidiaries, affiliates,
suppliers, distributors, advertising/promotion agencies, and prize
suppliers, as well as the respective officers, directors, employees
and agents of each of the foregoing (collectively, the "Released
Parties") from and against any loss, liability, damage, claim
or cause of action, including, but not limited to, personal injury,
death, or damage to or loss of property, arising out of participation
in the Sweepstakes or receipt or use or misuse of any prize. Winners
further acknowledge that the Released Parties have neither made
nor are in any manner responsible or liable for any warranty, representation
or guarantee expressed or implied, in fact or in law, relative to
any prize, including, but not limited to quality or fitness for
a particular purpose.
9. Publicity: Except where prohibited, participation in the Sweepstakes
constitutes winner's consent to Sponsor's and its agents' use of
winner's name, likeness, photograph, voice, opinions and/or hometown
and state for promotional purposes in any media, worldwide, without
further payment or consideration.
10. General Conditions: Sponsor reserves the right to cancel, suspend
and/or modify the Sweepstakes, or any part of it, if any fraud,
technical failures, virus, bugs or any other factor beyond Sponsor's
reasonable control impairs the integrity or proper functioning of
the Sweepstakes, as determined by Sponsor in its sole discretion.
In such event, Sponsor reserves the right to award the prizes at
random from among the eligible entries received up to the time of
the impairment. Sponsor reserves the right in its sole discretion
to disqualify any individual it finds to be tampering with the entry
process or the operation of the Sweepstakes or to be acting in violation
of these Official Rules or any other promotion or in an unsportsmanlike
or disruptive manner. Any attempt by any person to deliberately
undermine the legitimate operation of the Sweepstakes may be a violation
of criminal and civil law, and, should such an attempt be made,
Sponsor reserves the right to seek damages from any such person
to the fullest extent permitted by law. Sponsor's failure to enforce
any term of these Official Rules shall not constitute a waiver of
that provision.
11. Limitations of Liability: The Released Parties are not responsible
for: (1) any incorrect or inaccurate information, whether caused
by participants, printing errors or by any of the equipment or programming
associated with or utilized in the Sweepstakes; (2) technical failures
of any kind, including, but not limited to malfunctions, interruptions,
or disconnections in phone lines or network hardware or software;
(3) unauthorized human intervention in any part of the entry process
or the Sweepstakes; (4) technical or human error which may occur
in the administration of the Sweepstakes or the processing of entries;
or (5) any injury or damage to persons or property which may be
caused, directly or indirectly, in whole or in part, from participant's
participation in the Sweepstakes or receipt or use or misuse of
any prize. If for any reason a participant's entry is confirmed
to have been erroneously deleted, lost, or otherwise destroyed or
corrupted, participant's sole remedy is another entry in the Sweepstakes,
provided that if it is not possible to award another entry due to
discontinuance of the Sweepstakes, or any part of it, for any reason,
Sponsor, at its sole discretion, may elect to hold a random drawing
from among all eligible entries received up to the date of discontinuance
for any or all of the prizes offered herein. No more than the stated
number of prizes will be awarded. In the event that production,
technical, seeding, programming or any other reasons cause more
than stated number of prizes as set forth in these Official Rules
to be available and/or claimed, Sponsor reserves the right to award
only the stated number of prizes by a random drawing among all legitimate,
unawarded, eligible prize claims.
12. Disputes: Except where prohibited, participant agrees that:
(1) unless otherwise provided herein, any and all disputes, claims
and causes of action arising out of or connected with this Sweepstakes
shall be resolved individually, without resort to any form of class
action, and exclusively by the United States District Court for
Western District of Washington; (2) any and all claims, judgments
and awards shall be limited to actual out-of-pocket costs incurred,
including costs associated with entering this Sweepstakes, but in
no event attorneys' fees; and (3) under no circumstances will participant
be permitted to obtain awards for, and participant hereby waives
all rights to claim, indirect, punitive, incidental and consequential
damages and any other damages, other than for actual out-of-pocket
expenses, and any and all rights to have damages multiplied or otherwise
increased. All issues, disputes, claims and questions concerning
the construction, validity, interpretation and enforceability of
these Official Rules, or the rights and obligations of the participant
and Sponsor in connection with the Sweepstakes shall be governed
by, and construed in accordance with, the laws of the State of Washington,
U.S.A. without giving effect to any choice of law or conflict of
law rules whether of the State of Washington or any other jurisdiction,
which would cause the application of the laws of any jurisdiction
other than the State of Washington. Notwithstanding any provision
of these Official Rules to the contrary, all issues, questions,
claims, disputes and controversies relating to the prizes awarded
in the Sweepstakes shall be governed by and construed in accordance
with the laws of the State of Washington, U.S.A. without giving
effect to any choice of law or conflict of law rules whether of
the State of Washington or any other jurisdiction, which would cause
the application of the laws of any jurisdiction other than the State
of Washington.
13. Participant's Personal Information: Information collected from
participants is subject to Sponsor’s Privacy Policy located
at http://www.pba.com/corporate/privacypolicy.asp
14. Newsletter: By agreeing to the Sweepstakes Terms and Conditions,
participants will be automatically subscribed to Sponsor’s
newsletter. The newsletter will be sent to the e-mail address provided
by the participant. Participants will be provided with an unsubscribe
link in each newsletter they receive. Participants are free to unsubscribe
at their own will, any time after receiving their first newsletter.
Sponsor will not share or re-distribute the participant’s
e-mail address to any third party.
15. Sweepstakes Results: For a winner list and/or a copy of these
Official Rules, send a hand-printed, self-addressed, stamped envelope
to Professional Bowlers Association 719 Second Avenue Suite 701
Seattle, WA 98103 Winner list requests must be received by April
5, 2007. VT residents may exclude return postage.
